Currently we offer two primary options for people looking to file bankruptcy in California.  First, depending on what district your county belongs to, we can complete the 21-27 forms by typing the answers for you. This is our cheapest option, and depending on your situation, it may be a viable one, however for most cases it's not recommended.

On the other hand, you may choose to hire us and a Bankruptcy attorney we use on a limited basis . This option compared to other Bankruptcy attorneys is priced modestly due to our status as California registered legal document assistants, and our willingness to shoulder a lot of the paperwork. For more info on Legal Document Assistants: Reference CA BUSINESS AND PROFESSIONS CODE – BPC § 6400, et seq, or scroll down below.

Option 1 without Attorney

Option 1 is pretty straight forward due to the strict regulations (11 U.S. Code § 110)  surrounding petitioners filling Pro se. As mentioned above, assisting a petitioner that chooses to represent himself essentially means filling in the answers on the forms.

As stated in the Central District's preparer guidelines, even "explaining information necessary to complete the bankruptcy petition"  constitutes unauthorized practice of law.

Many clients just looking for an automatic stay to avoid creditors or foreclosure proceedings are sometimes incentivized by option 1. The problem is that while most people are aware of the benefits of a successful bankruptcy, they aren't aware of stats of the unsuccessful ones. Case filed Pro se have a success rate of around 0.04 - 0.05%. This means about 1 in every 2,500 cases filed Pro se succeed. In addition, a lot of those cases don't even make it pass the 341 hearing.

Now this doesn't necessarily mean your Pro Se case will be a negative statistic. You may well be a person that can navigate through the complexities of both federal and state statutes. If you believe you are, we're happy to help with option one.

Price for Option 1 is $200.

Option 2 with Attorney

We protect everything legally possible. By using an attorney, our services are included with his. Any questions or concerns you have can be answered through a free consultation. Generally speaking, the process involves: intake, review and representation at your 341 hearing. However, because 341 representation is recommend, but not mandatory, you may waive this service depending on your budget.

Our cooperating attorney has extensive experience in chapter 7 and chapter 13 proceedings and can explain the nuisances of each proceeding to determine under which chapter of the code to file your petition. We understand there is nothing more frustrating then dealing with debt, and we're acutely aware of how that frustration transfers into daily life.

Ultimately the attorney's goal is to provide the most efficient service possible in relation to the unique/common characteristics of your case. This may involve, but is not limited to: Information regarding the claiming of exemptions, discussing the impact that a bankruptcy filing may have on an eviction or foreclosure proceeding; and discussing or assisting a debtor with determining whether a certain debt should be reaffirmed or redeemed.

Price for Option 2 is $900 with $450 to start.

Any payments following are fact specific and will be discussed on the complexities of the case. Clients must sign a consent to spilt fees between L.D.A and attorney.

Case of the Month

MINH-VU HOANG v. JEFFREY LOWERY

https://mdcourts.gov/data/opinions/coa/2020/17a19.pdf

This case determined that CJ §5-202 does not operate to toll the statute of limitations on a claim against a bankruptcy debtor that does not result in a dismissal of the petition.

The righteous keep moving forward, and those with clean hands become stronger and stronger.

What is an LDA?

In California a Legal Document Assistant is an independent paralegal licensed and qualified by the state. The primary aspect of a Legal Document Assistant is to expand the affordability of judicial access. We have been conditioned to believe we need to hire an attorney to handle all legal matters. However, besides criminal cases where one's freedom is at jeopardy, California has encouraged self representation in many forms through the California Judicial Branch. As such, Legal Document Assistants are permitted to perform many of the same functions of attorneys in the absence of providing legal advice. When planning to use a Legal Document assistant, it's beneficial to know what you need before you enlist one. Just in case you're unsure, here is a comprehensive list of some of the most common requests -

Divorce petitions and responses, Unlawful Detainers, Parental Establishment Petitions, Ex Parte OrdersChild Custody and Support Petitions, Request for Orders, Probate petitions, Restraining Orders,  Deed Transfers,  Affidavits,  Last Will & Testaments, Trusts,  Power of AttorneyLien Waivers,  Small Claims, and other Court Packet Forms, Lawsuit Complaints, Motions,  Discovery Documents, Fee Waiver, Motion to Strike, Demurrer, Law Suit Answers/ Response, Special  Interrogatories, Request for admissions, Form Interrogatories, Motion for Extension of time, Motion to Quash, Motion to Compel, Renew Judgment,  CA Sister State Judgement
