Getting Sued?

If you can't reasonably afford an attorney, an alternative is to file the proper response papers as a pro se litigant to avoid losing by default. Legal collection methods include bank levies, wage garnishing and driver license revocation.

Although motions to dismiss can be effective in dismissing cases at their earlier stages, most cases do not contain the flaws required -such as when the statute of limitations expires or when improper venue is at issue. This make sense from a practical standpoint as these flaws are some of the first things considered before a plaintiff's attorney decides to sue.

   Why Respond?

Responding tells the other side you're willing to see this through. In other words, you're willing to show up to court. If you're at least open to doing that, then you're essentially shifting some of the burden back to the Plaintiff. 

                                          After Responding

Once the plaintiff's attorney has been mailed the response, and the proof of service documents have been filed - the case dynamic changes.  The plaintiffs now know that they won't be showing up to collect a judgement. Instead, they'll be showing up to a Trial Setting Conference (TSC) hearing. Sometime this alone is enough to result in plaintiff's failure to appear.  Debt buyers especially aren't really setup for lawsuit trials. It's a numbers game, and many of them are just hoping to a obtain default judgement; the procedural path of least resistance. Anything more increases the cost and risk of their initial investment.   



 

Every year 2 million Californians are sued for a debt.  In 2023 a whopping 83. 4 percent of them lost by default because they didn't respond in a timely manner.
